Is there any harm in settling my case if the insurance company is willing to offer me the policy limits without me having to hire an attorney?
Any reputable personal injury attorney will be glad to sit down and give you advice, free of charge, in situations like this. The last thing you want to do is to settle the case without discussing the matter with an attorney. There may be another Defendant, another policy, you may void coverage on the Underinsured Motorist portion of your policy, or there may be lien holders that have the first right to your settlement – in short there are many reasons that you should never settle a claim without first consulting an attorney.
Can I settle my property damage claim without harming my bodily injury claim?
Yes, in fact many times an attorney is not needed. But be very careful that you are only settling the property damage portion of your claim and understand that property damage means anything other than your personal injury claim. If there was damage to other property in your car or on your person, you should consult with an attorney to make sure you are not giving away part of your claim. Also, be careful to pay attention to the check to make sure it does not state something to the effect of “full and final settlement of any and all claims” as there are some insurance companies who simply do not play fair and try to claim that by executing a check like this would operate to settle your whole claim. Just remember, if there is any doubt, consult an attorney!
What is Personal Injury Protection and should I get this on my policy of insurance?
Personal Injury Protection (PIP) pays for 80 percent of your lost wages and 100 percent of your medical bills if you are injured in a car wreck, no matter who was at fault. This PIP coverage pays regardless of the at fault party’s insurance and also applies if you were riding in someone else’s vehicle. Though we live in a tough economic time, if there is anyway you can afford Uninsured/Underinsured motorist coverage and PIP, please see that these two items are on your policy. There are a lot of uninsured drivers out there and PIP is always a great safety net.
